Estate Planning

We realize that every client's situation is unique, therefore every estate plan we prepare is customized to the needs and objectives of that particular client.  We invest the time necessary to get to know our clients, including the nature and extent of their assets, their family dynamics, and their desires and objectives.  We carefully tailor every estate plan to accomplish the client's goals taking into consideration potential tax implications.

In addition to wills (both simple and complicated trust wills), we offer comprehensive living trust packages, which include the following documents, as applicable:

  • Revocable Trust
  • Pour-over Will(s)
  • General Durable Power(s) of Attorney
  • Advance Health Care Directive(s)
  • Certification of Trust
  • Assignment of Property
  • Deed(s) and related documents necessary to transfer interests in real property into the trust
  • Community Property Declaration (for married couples)

Probate Administration

We have extensive experience in the area of probate administration, and have the experience and knowledge required to handle probate matters involving estates of all sizes and complexities, ranging from simple estates to large estates comprised of business interests or multiple interests in real estate.  In addition, since attorney Paul J. Mori is a licensed California real estate broker (see Real Estate Transactions), we are able to offer the estate representative the ability to list and sell any estate real property without the need of hiring an outside real estate agent.  If the representative chooses to list the property with Mr. Mori, we waive any extraordinary attorney's fees related to the sale of the property.  We practice before the Probate Court in several Bay Area counties, including Alameda, Marin, San Francisco, San Mateo, and Sonoma.

Trust Administration

We also offer complete postmortem trust administration, including post-death tax planning, including advice regarding the use of disclaimers.  We assist the Trustee with selling any necessary assets and prepare documents to effectuate the transfer of assets to the beneficiaries.  We work closely with accountants to resolve any tax issues that may arise and to ensure the proper preparation of any required tax returns.

Real Estate Transactions

We assist clients with a broad array of residential and commercial real estate transactions, including preparing and drafting sale and purchase agreement, leases, tenancy-in-common agreements and other real estate related agreements.  In addition, attorney Paul J. Mori is a licensed California real estate broker and Realtor®. Unlike a real estate agent, who is prohibited from providing legal advice to clients, Mr. Mori can assist and advise clients with respect to all aspects of a real estate transaction from marketing the property to legal matters such as clearing up any title issues that appear in the preliminary title report.  In addition, Mr. Mori has over 15 years of experience negotiating and drafting both real estate and non-real estate transactions.  As a result, he is able to utilize his legal experience and training to get the best results for his clients.

Mr. Mori's provides a wide-array of real estate services that can be specifically tailored to a client's needs.  These services include:

  • Assisting a buyer locate and acquire a property
  • Assisting sellers market and sell a property, including the preparation of legally mandated disclosures
  • Providing full brokerage services, including listing the property on the San Francisco multiple listing service (MLS)
  • Preparing a comparative market analysis (CMA) of the property
